IMPORTANT: PLEASE READ CAREFULLY. This document addresses risks associated with participation in basketball and related activities. It is intended to operate only to the maximum extent permitted by Ontario law.

1. Participant and Activities

This agreement applies to the participant’s involvement in Haldimand Hoops programs, free trials, practices, drills, scrimmages, clinics, camps, conditioning, demonstrations, events and related use of gyms, courts, change areas and other facilities.

2. Acknowledgement of Risks

I understand that basketball and physical training involve inherent and foreseeable risks. These risks may arise even when reasonable care is taken.

• running, jumping, stopping, pivoting, shooting, passing and dribbling;
• falls, slips, trips and loss of balance;
• contact or collisions with other participants, coaches, balls, walls, floors, nets, hoops, benches or equipment;
• sprains, strains, bruises, cuts, dislocations and fractures;
• head, face, dental, eye or concussion injuries;
• aggravation of a pre-existing condition, dehydration, overexertion or other physical reactions;
• facility conditions, equipment failure, or the actions or mistakes of other participants;
• rare but potentially serious injury, permanent impairment or death.

3. Health and Medical Information

I confirm that I will disclose known medical conditions, allergies, injuries, activity restrictions and emergency information that may reasonably affect safe participation. I will not knowingly allow the participant to participate contrary to medical advice or when participation is unsafe.

4. Assumption of Inherent Risks

On behalf of myself and, where permitted by law, the participant, I voluntarily accept the ordinary and inherent risks of basketball and related physical activity that cannot be eliminated without changing the nature of the activity.

5. Emergency Response

I authorize Haldimand Hoops personnel to provide reasonable first aid and to contact emergency medical services when they reasonably believe it is necessary. I understand that Haldimand Hoops cannot guarantee the availability or outcome of medical care.

6. Release and Hold Harmless – To the Extent Permitted by Law

To the maximum extent permitted by applicable law, I release and agree to hold harmless Haldimand Sports Academy, operating as Haldimand Hoops, and its directors, officers, coaches, volunteers, employees, contractors, agents and representatives (collectively, the “Released Parties”) from claims by me arising from the ordinary and inherent risks of participation that I have knowingly accepted under this agreement.

Nothing in this agreement is intended to exclude liability that cannot legally be excluded, to waive rights that a parent/guardian cannot legally waive on behalf of a minor, or to excuse reckless, intentional or other conduct for which a release is prohibited by law.

7. Parent/Guardian Responsibility

As parent/guardian, I agree to supervise and make appropriate decisions for the participant, comply with safety and return-to-play directions, provide accurate emergency and health information, and promptly collect the participant when requested for injury, illness, behaviour or safety reasons.

8. Indemnity for Parent/Guardian’s Own Conduct

To the maximum extent permitted by law, I agree to indemnify the Released Parties for losses or claims directly caused by my own negligent, reckless or intentional acts or omissions, including knowingly providing materially false health, pickup or emergency information. This clause does not require me to indemnify a Released Party for that party’s own negligence or unlawful conduct.

9. Personal Property

I understand that Haldimand Hoops cannot guarantee the security of personal property brought to a facility. Participants should bring only necessary items and keep valuables secure.

10. Severability and Ontario Law

This agreement is governed by Ontario law. If any part is found invalid or unenforceable, the remaining provisions will continue to operate to the extent permitted by law.

Acknowledgement and Consent

I confirm that I have read this agreement, understand the risks described above, have had the opportunity to ask questions, and voluntarily consent to the participant taking part in Haldimand Hoops activities.
